To qualify for diversion, the defendant must plead guilty but the judgement and conviction is delayed such that the defendant can complete all diversion requirements, classes, counseling, conditions, program fees, and, if applicable, timely pay the victims’ restitution expenses. If the restitution expenses exceed $2000, the defendant is not eligible for diversion. The program consists of 7 1/2 hour classes or a 4 hour class. Not all cases are eligible. If diversion requirements are successfully completed, the charges will be dismissed.
